Terms of Service

These Terms are a legal agreement between you and Ridgepath Technologies (OPC) Private Limited, a company incorporated in India with its registered office in Jaipur, India ("Mistflow", "we", "us"). By using Mistflow ("the Service"), you agree to these Terms, our Privacy Policy, our Data Processing Agreement (for customers whose applications process personal data of end users), and our Subprocessors list. If you don't agree, don't use the Service. If you use the Service on behalf of an organization, you represent you have authority to bind it.
What Mistflow Does
Mistflow is an MCP server and platform that helps you plan, build, and deploy web applications through AI coding editors. We provide infrastructure orchestration (hosting, databases, authentication) — not AI inference for your editor. When you call mist_plan, our backend uses Anthropic's Claude API to generate a technical plan; see the Privacy Policy. Your AI editor subscription is separate from Mistflow.
Your Account
- You need an account to deploy apps. Sign up via Clerk authentication.
- You're responsible for keeping your account credentials and API keys secure.
- Every user needs their own account. Organizations can invite members from the dashboard; do not share individual account credentials.
- You must be at least 18 years old to use the Service. Under India's Digital Personal Data Protection Act 2023, we do not knowingly process personal data of anyone under 18 without verifiable parental consent, and we do not offer the Service to minors.
Your Apps and Data
- You own your code. Apps you build and deploy through Mistflow are yours. We don't claim ownership of your source code, build artifacts, or data.
- You're responsible for your apps. We host them, but you alone are responsible for their content, legality, security, and behavior.
- Environment variables are encrypted. We store them using a Fernet envelope scheme and never expose them in logs or error messages.
AI-Generated Output
Two distinct AI systems are involved when you use Mistflow, and neither is under Mistflow's editorial control:
- Plans are generated by our backend via Anthropic's Claude API. A plan describes the intended architecture, feature breakdown, and file structure of your app. Mistflow does not write your application's source code.
- Application code is generated by the AI coding editor you choose to use (for example, Claude Code, Cursor, Codex, or GitHub Copilot), operating under your own subscription and agreement with that editor's provider. Mistflow does not select, control, or audit the code produced by your editor.
You acknowledge and agree that:
- Both plans and code are produced by probabilistic AI models and may be inaccurate, incomplete, insecure, or fail to function as intended.
- Generated output may resemble publicly available code; you are solely responsible for reviewing it for correctness, license compatibility, and security before deploying it to production.
- You, not Mistflow, are responsible for all consequences of running generated code, including data loss, security incidents, downtime, and infringement claims — regardless of whether the code was produced by your AI editor or influenced by a plan generated through Mistflow.
- Your AI editor's output is governed by your agreement with that editor's provider; Mistflow is not a party to that agreement and disclaims all liability for the editor's behavior or output.
- You must not use the Service to build or deploy applications that violate the terms of service of any upstream AI provider (including Anthropic's Usage Policy and Service Specific Terms), which are incorporated by reference.
Security of Your Application
Mistflow secures the infrastructure layer it operates (as described in the Privacy Policy and the Technical and Organisational Measures in our DPA). Mistflow does not secure the application layer — the code your AI editor writes, the data model you define, the authentication and authorization flows within your app, the configuration of third-party integrations you enable, or how you handle input from your end users. That is your responsibility, and you alone are best positioned to test it.
You represent and warrant that, before making your application available to end users and periodically thereafter, you will test your application for common security vulnerabilities, including at a minimum: SQL and NoSQL injection, cross-site scripting (XSS), broken authentication and session management, broken access control, insecure direct object references, sensitive data exposure, insecure configuration of third-party integrations, and inadequate rate limiting. You are solely responsible for patching vulnerabilities in your application and for any consequences of failing to do so.
Acceptable Use
Don't use Mistflow to:
- Deploy malware, phishing sites, spam, or illegal content
- Host content that infringes someone else's rights
- Abuse the ephemeral deploy system or circumvent rate limits
- Attempt to access other users' projects or data
- Reverse-engineer, resell, or rebrand the Service without written permission
- Circumvent usage limits, billing, or security measures
- Use the Service in any country or by any person subject to U.S. sanctions or export restrictions
Pricing and Billing
- Current pricing is published at mistflow.ai/pricing. The free tier is available as long as we continue to offer it.
- Paid plans are billed in advance per billing period. You only pay for apps that are live; delete an app and billing for it stops at the end of the current period.
- All sales are final and payments are non-refundable except where required by law.
- We may change pricing at any time. Price changes take effect at your next billing period.
- Applicable taxes are your responsibility.
Service Availability
- We aim for high availability but do not guarantee any specific uptime. The Service is provided "as is" and "as available."
- Your apps are hosted on Cloudflare and third-party infrastructure; outages, bugs, or policy changes at those providers are outside our control.
- We may perform maintenance, modify features, or discontinue parts of the Service at any time.
Termination
- You can delete your account and all associated data at any time.
- We may suspend or terminate your account at any time, with or without notice, for any reason — including violation of these Terms, suspected abuse, non-payment, or security risk.
- On termination, deployed apps will be taken offline and data may be deleted. Export anything you want to keep before terminating.
No Warranty
The service, including all ai-generated output, is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, security, or that the service will be uninterrupted, error-free, or free of harmful components. you use the service at your own risk.
Limitation of Liability
To the maximum extent permitted by applicable law, mistflow and its operators, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business, or substitute services, arising out of or relating to the service, your use of or inability to use it, any ai-generated output, any security incident or data loss, any third-party subprocessor outage or breach, or any content you or others post or deploy — regardless of the theory of liability (contract, tort, statute, or otherwise) and whether or not mistflow has been advised of the possibility of such damages.
Mistflow's total aggregate liability for any and all claims arising out of or relating to the service in any twelve-month period is limited to the greater of (a) the amount you paid mistflow in that period, or (b) one hundred u.s. dollars ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions the exclusions and limits above apply only to the maximum extent permitted by law.
Indemnification
You will defend, indemnify, and hold Mistflow and its operators harmless from and against any claim, liability, loss, damage, or expense (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) any content, app, or code you build, deploy, or host via the Service; (c) your violation of these Terms or of any third party's rights; or (d) your violation of any law.
Governing Law and Disputes
These Terms are governed by the laws of India, without regard to conflict-of-laws rules. The courts at Jaipur, India will have exclusive jurisdiction over any dispute arising out of or relating to the Service or these Terms, and you consent to personal jurisdiction there. You waive any right to participate in a class, collective, or representative action. This section does not limit any non-waivable statutory right you have under the law of your country of residence.
Changes to These Terms
We may update these Terms. Material changes will be announced by email to account holders and posted here with a revised date. Continued use after changes take effect means you accept the updated Terms.
Miscellaneous
These Terms are the entire agreement between you and Mistflow about the Service and supersede any prior agreements. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our written consent; we may assign them freely, including on a sale or reorganization of the business. The provisions on AI-Generated Output, No Warranty, Limitation of Liability, Indemnification, Governing Law, and Miscellaneous survive termination.
